In a civil action, Alambik Ltd may chose between the amount we have lost because of your infringement (actual damages) plus lost profits attributable to the infringement, and statutory damages in as much as USD$150,000 per unlicensed copy.

In addition, if you or your company reproduces software without having been grated autorization by alambik Ltd, or sell, distribute or expose for sale any unlicensed software, you and/or your company may face criminal charges. In 1997, in the USA, the No Electronic Theft (NET) Act was signed into law removing the profit requirement to be liable for copyright infringement. Now, software pirates can be prosecuted without making any money on the illegal software.
